These Conditions are deemed accepted by the job seeker and client when the Services of Jobsiteahed.co.uk have been accessed by the job seeker and client or ordered and upon signature of the Service Agreement by the job seeker and client.

By accessing www.Jobsiteahead.co.uk and its associated websites, known both collectively and individually in these Terms as the "Website") you are agreeing to be legally bound by these terms as modified from time to time ("Terms"). Any use of the site by you after such changes are posted constitutes your agreement to these Terms as modified.

Before using the Website it is your responsibility to read the Privacy Policy and to notify us in the manner set out in the Policy if you do not want us to collect information about you, and reject any cookies in the manner set out therein.

Use of Website

The Website is owned and operated by U. Bhardwaj (hereinafter "UB"). UB reserves the right to suspend or terminate your access to the Website at any time, with or without notice or explanation.

Rights

All intellectual property rights, including copyright, in the content displayed on the Website ("Content") belong to UB or its licensors. All rights are hereby reserved.

Use of Content

The Website and the Content may only be used for your personal, non-commercial use.

For this purpose alone you may retrieve and display the Content on a computer screen. You may also print out, but not photocopy, one copy of individual files on paper and store files in electronic form on disc, but not on any server or any other storage device connected to a network where the pages could be accessed by other users.

Except as set out above, you agree not to download, copy, reproduce, modify, store, archive, show in public, redistribute or commercially exploit in any way any part of the Content without the prior written permission of UB. CVs and job advertisements contained on the site are provided by candidates and by prospective employers and their agents and are not reviewed by us. We accept no responsibility or liability for the contents of CVs or advertisements and expect candidates and prospective employers to carry out such verification procedures as are customary and prudent in the circumstances.

Jobsite Ahead.co.uk services

Services and information provided on the site by us and our third party suppliers are intended to assist in the job seeking or recruitment process. Neither we nor our third party suppliers can guarantee their suitability or prospects of success in any particular case. You should obtain independent verification before relying on information provided on the site in circumstances which may result in loss or damage.

Service availability

We try to ensure continuous availability of the site and all the services available on it but accept no responsibility for the consequences of interruptions or delays, however caused. We may, additionally, alter the design and specification of the site at any time.

Limitation of liability

Our liability, and the liability of our third party suppliers, for any loss or damage suffered by you as the result of your use of this site is limited to your actual direct damages and, except in the case of fraud, excludes any loss of future earnings, profit or prospects or any consequential or speculative loss. As required by law, this exclusion does not extend to death or personal injury caused by our negligence.

Credit card payments

Jobsite Ahead' all job seeking services are free to use. However, some non-core services require payment to access. The payments are made by credit card using PayPal's secure transaction environment. Please visit www.Paypal.co.uk web site for more information.

For Recruiters

Commencement of Services

We will not commence the provision of Services pursuant to any Order Form until the Order Form has been returned to us, in a form approved by us and signed by the Customer.

Prices

Prices are guaranteed for the period stated on the Order Form. Prices are confidential and may not be disclosed by the Customer.

A job posted on JobsiteAhead.co.uk will remain live for 90 days or such shorter time as we agree with the Customer. Any extension of this time will be charged to the Customer as a new posting. Any jobs posted in addition to the agreed number of jobs per month will be charged at a price per job agreed with the customer at the time of the contract negotiation. If no price has been negotiated, a flat fee of £49 per job will be charged for each job over the agreed number. A single job is identified by its unique ID number. If a customer deletes a job and then either reposts it or posts another, this will be classed as two jobs.

If any Services to be used within any time period specified on the Order Form are not used within that period of time they may not be carried over into any subsequent period without our prior written consent. The Customer will be responsible for payment for any unused Services.

Payments

All prices exclude VAT. All invoices are payable within 30 days. Late payment will entitle us to suspend provision of Services. Interest will be payable on late payments at the rate of 3% above National Westminster Bank plc's base rate from time to time.

Termination

The Customer may terminate the provision of Services under any Order Form by no less than 30 days notice to expire at the end of a Contract Month. Termination by the Customer before the end of the Contract Term may, at our discretion, result in loss of discounts agreed for the entire Contract Term.

We may terminate the provision of Services if:

the Customer is in material breach of these terms and conditions and has not remedied such breach within ten days of notice specifying the breach and requiring that it be remedied, or:

the Customer becomes insolvent, ceases to trade or goes into liquidation.

Job posting

Employment agencies and employment businesses

If you are an employment agency or an employment business (as defined by the Employment Agencies Act 1973 ('the Act')) it is your responsibility to ensure that advertisements you place on JobsiteAhead.co.uk comply with your obligations under the Act and Conduct of Employment Agencies and Employment Businesses Regulations 2004. You agree to comply with the Act and these regulations as they affect the conduct of your business and the advertisements you place on JobsiteAhead.co.uk.

Site rules

We have rules regarding the content and format of jobs posted on JobsiteAhead.co.uk. Their purpose is to ensure that users who search the site or the JobsiteAhead.co.uk database get results which are presented as clearly and informatively as possible. You agree that we may, at our discretion and without liability to you, remove from JobsiteAhead.co.uk any advertisement which is posted in breach of these rules. The rules may change from time to time and you are advised to refer to them regularly.

The Rules are:

No duplicating of jobs at the expense of other clients' jobs.

No gratuitous use of keywords in job descriptions or job titles. Gratuitous means deliberately inserting words, strings of words, or repeating job titles, with the intention of influencing position in the results listing, or increasing the number of page views.

Job advertisements placed on JobsiteAhead.co.uk must be for genuine vacancies only, and not for other products or services, either relating to or unrelated to recruitment including, but not limited to, affiliate schemes, pyramid selling schemes or any other so called 'business opportunity'.

URLs or email links (live or text only) are not permitted in the body copy of the job description page. Email links are permitted from the 'send an email' link and url linking is permitted from the 'apply online' link.

Illegal Advertisements

Advertisements which appear to discriminate on grounds of sex, race or disability are illegal and may result in proceedings being taken against both the advertiser and the publisher. If we believe that an advertisement may be discriminatory we may at our discretion either amend the advertisement or remove it from JobsiteAhead.co.uk without liability to you to make any refund of amounts paid or due to be paid in respect of the posting or otherwise and will inform you accordingly.

Responses to advertisements

You agree to deal fairly and professionally with individuals who may respond to an advertisement you have posted and not do anything which may bring totaljobs.com into disrepute. You will indemnify us from and against any claim brought by an individual against JobsiteAhead.co.uk arising from your breach of this obligation or any other of these terms and conditions.

We do not guarantee any response to your advertisement or that responses will be from individuals suitable for the job advertised. It is your responsibility to carry out such checks and procedures as are necessary to ensure that candidates are suitable for the job advertised and have the required qualifications and personal characteristics.

Equipment

It is your responsibility to ensure that you have the appropriate equipment and are connected to the appropriate services to enable you to post jobs to JobsiteAhead.co.uk.

Links from other sites

Third parties are permitted to link to stories within UB websites, using the URL and quoting the headline and the source website. Brief extracts from a story are permitted provided they are not substantive. Otherwise our material must not be reproduced on a third party site without express authorisation from us. Requests for more extensive material should be made in writing to Job Site Ahead.co.uk, 45 Kennett Square, Mitcham, CR4 3RR Surrey England.

A third party must ensure that nothing on its own web site suggests or could be understood to imply that any part of the website is part of its own web site unless the third party has obtained the prior written approval of UB.

UB reserves the right to withdraw any permission without explanation or notice if in its sole judgement use of such links is excessive or inappropriate. UB also reserves the right to change the location and nature of files within the website without explanation or notice; it is the responsibility of the third party to check and update links as necessary.

Limitation of liability and disclaimer

UB obtains the Content from a wide range of sources and it includes facts, views, opinions and information likely to be of interest to users of the Website.

While all reasonable care is taken, we do not guarantee the accuracy, completeness, timeliness, performance or fitness for any particular purpose of the Content or the Website, nor do we endorse or accept any responsibility for any views, advice, recommendations or opinions expressed on the Website or any website to which we link. If you wish to make any purchases or enter any financial dealings on a co-branded site, you may be asked by the third party operator to supply information about yourself and on your financial affairs, including your bank or credit card details. The third party operator will have their own privacy policy and it is up to you to indicate your consent or otherwise of the use to be made by that third party in relation to the use of your personal data. While we select our trading partners with great care, UB cannot be held liable for any loss or damage whatsoever which you may suffer as a result of your decision to enter any dealings or transactions with or supply personal information to a trading partner or any third party. Your attention is drawn to the Privacy Policy.

Competitions, prize draws and promotions

UB may on occasion run competitions or prize draws either on its own behalf, for other parties or in conjunction with commercial partners. These will be subject to additional rules and conditions which will be made available at the time of any such competition.

Submission of content to the Website

If you submit any contribution to this Website (including without limitation any text, graphics, video or audio) you agree thereby to grant UB a perpetual, royalty-free, non-exclusive, sub-licenseable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, play, and exercise all copyright and publicity rights with respect to any such work worldwide and/or to incorporate it in other works in any media now known or later developed for the full term of any rights that may exist in such content. You indemnify UB against all legal fees, damages and other expenses that may be incurred by UB as a result of your breach of the above warranty. You agree to waive any moral rights in your contribution for the purposes of its submission to and publication on the Website and the other purposes specified above.

UB reserves the right to make changes to any part of the Website and to add to or change these Terms or the Privacy Policy. English Law

By accessing the Website you agree to accept that these Terms are governed by and construed in accordance with the laws of England. You also accept the exclusive jurisdiction of the English Courts in relation to any dispute that may arise in connection with these Terms or your use of the Website or arising in any way from the Content. For the exclusive benefit of UB, UB shall retain the right to bring proceedings as to the substance of the matter in the courts of the country of your residence or, where these Terms are entered into in the course of your trade or profession, the country of your principal place of business.
